Nomination for immovable property

“Many people have nominees who are not their legal heir, which later creates confusion. My advise is, make a will to clarify your wishes, and to avoid confusion, make your will and nominations in favor of one person,” said Mr Vimal Punmiya, veteran chartered accountant and property expert. He was speaking at the 100th seminar organized by Moneylife Foundation.

He said nominee is like an executor, who is entrusted to manage the property or asset as per the nominator’s wishes after his death. But a nominee cannot sell property unless he is a legal heir. “Also, after his (nominee’s) death, his heir cannot act as a nominee for that asset. In addition, if the nominee passes away before the nominator, a new nominee must be appointed. If nominee dies after the death of the policyholder, but before receiving policy money, then also nomination becomes ineffective and the money can be claimed only by the legal heirs of the policy Holder.

He said, “Under section 18 of the Registration Act the registration of a will is not compulsory. But it is strong legal evidence, if there is a quarrel latter, that the proper parties had appeared before the registering officers and the latter had attested the same after ascertaining their identity.”

When asked about a will in favor of someone who is not the natural heir, Mr Punmiya said, “I would still advise that you mention clearly what you want. Suppose your elder son is the heir by succession, but you want to leave everything to your younger son, mention clearly that you have allotted some money to the elder one, or that you do not wish to leave anything for him because he is doing well for himself, and then, making a list of your assets, mention that all these you leave in the favor of the younger son.”

Mr Punmiya also talked about the several procedures involved in transfer of property or other assets after the death of a nominator. “I would advise everyone to keep copies of nomination forms, share certificates and other relevant documents because many times, cooperative housing societies lose the forms,” he said. In case someone loses share certificates, one must apply for issue of duplicate certificate. The moment duplicate certificate is issued, the original ceases to exist, Mr Punmiya said while sharing his own experience during a journey.

When asked about properties left by NRI citizens abroad, he said, “For such matters separate wills must be made, one for the properties abroad, and other for properties in India.”

When asked about the place of registering the will, he replied that it is usually done from the place where the testator (the person making a will) holds a voter-ID card or ration card or any such residence proof. But if someone goes elsewhere and passes away, he can make a will before his death and that will be valid.

When asked about the needs of special children, he said that setting up a trust in the name of that child with a trusted executor is commendable.

Mr Punmiya also talked about liabilities of taxation of heirs and nominations in property matters. He said, “If a property is jointly owned, the owners can each appoint their own nominees, or can nominate a single person together.”

He also said that assets which are unaccounted for can be willed and after six years have passed when the assets were acquired, they cannot be taxed. “For example, if someone leaves some jewellery which is not unaccounted for, income tax officials cannot seize the ornaments or demand tax six years after the heir has acquired them,” he said.

“Co-operative housing society has no power, except provisionally and for a limited purpose to determine the disputes about who is the heir, or legal representatives. The society is only meant to provide for interregnum between the death and the full administration of the estate and not for the purpose of conferring any permanent right of such person to a property forming part of the estate of the deceased,” Mr Punmiya added.

Washington, Nov 21 (IANS) The more often married individuals above the age of 65 engage in sex, the more likely they are to be happy with both their lives and marriages.

Based on the survey responses of 238 married individuals aged 65 years or older, Adrienne Jackson found that frequency of sex significantly predicted both general and marital happiness.

The link even remained after accounting for factors such as age, gender, health status, and satisfaction with financial situations, said Jackson, assistant professor at Florida Agriculture and Mechanical University.

While only 40 percent of individuals who reported no sexual activity in the last 12 months said they were very happy with life in general, almost 60 percent who engaged in sexual activity more than once a month said they were very happy, according to a Florida statement.

Similarly, while about 59 percent of individuals who reported no sexual activity in the last 12 months said they were very happy with their marriage, almost 80 percent who had sex more than once a month said they were very happy.

To assess frequency of sexual activity, respondents were asked the following question: 'About how many times did you have sex during the last 12 months? By 'sex' we mean vaginal, oral, or anal sex.'

To assess general happiness, respondents were asked the following question: 'Taken all together, how would you say things are these days - would you say that you are very happy, pretty happy, or not too happy?'

To assess marital happiness, respondents were asked the following question: 'Taking things all together, how would you describe your marriage? Would you say that your marriage is very happy, pretty happy, or not too happy?'

These findings were presented at The Gerontological Society of America's (GSA) 64th Annual Scientific Meeting in Boston.

Old Woes - Say maharashtra yet to implement policy on elders, submit demands to pm, cm

The National Policy on Older Persons (NPOP, 1999) has been adopted by only seven states, including Goa, Kerala, Karnataka, Madhya Pradesh, Andhra Pradesh, Rajasthan and Delhi. This and other issues concerning the welfare of senior citizens were taken up by the Tata Institute of Social Sciences (TISS) along with several senior citizens' associations on Wednesday. It included representatives from All India Senior Citizens Confederation and Federation of Senior Citizen of Maharashtra.

"The state governments are largely indifferent to the problems of senior citizens. The status of adoption of NPOP by various states, even after 12 years of its promulgation by the Centre, is bleak. Despite assurances, Maharashtra is yet to adopt it. Though mandated in the NPOP, no health security has been provided by most states. In the absence of state subsidised health insurance, if a senior citizen falls ill, quality health care is unaffordable," said Nasreen Rustomfram, chairperson of Centre for Lifelong Learning, TISS.

Demanding that the focus of state governments should be to implement the provisions laid down by the Centre, it was decided to observe August 16 as the "senior citizens national solidarity day" across India.

A memorandum, highlighting their demands, have also been submitted to Prime Minister Manmohan Singh and Maharashtra Chief Minister Prithviraj Chavan by the joint action committee of senior citizens on Wednesday.

"We are submitting this memorandum on behalf of over one crore senior citizens in Maharashtra, about 66 per cent of whom are poor, 90 per cent are without any social or health security and over 20 per cent are lonely, surviving under the threat of criminal attacks. Even after 50 years of formation of the state, very little has been done by the government to improve the quality of life of its senior citizens," the memorandum said.

Provision of uniform fare concession of 50 per cent to all senior citizens without gender discrimination, escalators/lifts on all important stations and ramps on others, declaration of a comprehensive national policy for dementia and alzheimer patients and complete implementation of the National Programme for Healthcare of the elderly are some other demands. "Establishment of fast track courts for speedy, time-bound disposal of pending cases of senior citizens in all courts have also been demanded," she said.

I am ashamed of Baba Ramdev.says Celine ....and my relpy ....Alok

Those with blood in vains of slavery of 1000 yrs,  those with vested interest who have  unleashed propaganda against Baba and  those who fear what does not  exists nd r comfortable in present lawless state may not read. ...Alok 

I Celine Suresh state  that our international image is spoilt  because of people like Baba
Ramdev. It is was just when our country was  gaining a strong foothold in all fields... that
people like the Baba have to  spoilt it.
I further state that I was /am very proud of our imagge  abroad as :
  1.    naked women and men line up in the morning nr highway and railway line  for attending morning calls.
  2.   That many children in India die due to malnutrition/ under nourishment
  3.   That everyday a senior citizen is attacked 
  4.   that innocent girls are raped daily somewhere or other often in hospitals,  schools,police stations, place of politician
  5.   that many women everyday are beaten up by wife beaters and yet they are made hero of by their friends and relatives
  6.   that bride and her side has to bown down in the feet of groom , please them  at any cost, give them what they want or ..... get their daughter beaten,killed,separated,humiliated,insulted
  7.  that lovely young couple who fall in love are killed by family and media  calls it honour killing and not mad killing
  8.   that 75 % population are either not getting water or getting non potable  water
  9.   that you have to bribe for for laying pyre, then for getting death  certificate, then for getting probate, then getting names changed in property ,  licences of beloved decesed instead of getting sympathies at such times . And if  they can  take ur blood out ( for making Celine proud of India 's image) on  death of family members then u can imagine what harrassment is caused to Indians  on seeking various other permissions, licences, NOC.s, connections  etc  etc..
  10.   that every year many buildings fall and life and property are lost
  11.   that we have our govt hospitals, schools, gardens, roads , footpaths, other  estabilishment in pathetic condition and that makes me the Celine Suresh a happy  abt our image abroad.
  12.   that child labour, gender discrimation, suicides by farmers , poor, down  trodden all that gives me sukun/ kick of pride and I feel proud of  my nation abroad which Baba  Ramdev is tarnishing.
  13.   That even today harijan are insulted, not allowed to enter temples ( even if  come bathed, clean, healthy ) , punished for wearing shoes in so called mad  superiors lane but I celine am proud of the condition of backwards, adivasies, poor. 
  14.   And ofcourse I am proud of Bofors, Adarsh, 2 G, Raja, kani, Shahrukh,  sachin, MF husain etc who only minted money for self.
  15.   I am also proud of big frauds, big miracle man , fraud Babas ( who openly  advertise on media and dupe ) , astrologers who mislead and defraud innocents  and exploit others, who indulge in shame less acts but ofcourse I am against  Baba ramdev who teaches yoga and people willingly pay their fees to him , and or donate to him.
  16.   I am against Baba Ramdev as he has some money . But I dont want to know how  much satya Sai Baba had, how much Pope of Rome has, how much Aga Khan has, how  much respected saydena has ( but atleast made one good hospital in Mumbai), how much goes in coffers of Tirupati,Mahalxmi, Sidhivinayak , shirdi and how much is misused.
  17.   I am against those 4 ministers who received Baba Ramdev at Airport. Though I am not against top bureacrat and VIP who visited Satya sai baba the miracle man, and  babas like him, who attand marriages and darbar of Dawood and other mafias, top  police dancing in mafias party, I have great respect for all those filmies and  others who paid their respect and paid alms to Dubai mafia and feel proud for them as they get national awards, free plots, free FSI and suck blood of poor.  
  18.  I the Celine Suresh am greatly satisfied and feel proud that our govt spends  millions every month to protect Kasab, other underworld kings, politician, film  stars , those who spread communal voilence ( communal leaders) ,  those who  blackmailed our city elites for two decades and same govt  did brutal canning and fired  tear gas shells on innocent peaceful sleeping women, children , senior citizens  and even sadhus in the name of threat on Baba's life ( actually threat on money  stocked abroad) .. Cant go on as jo samjhata hai woh samjhta hai or jo falsehood  ke nashe mein dhutt hai use kya samjega??
  19.  I am not concerned when Indiraji was arrested and her folks went on rampage, I am not concerned how many sikhs died when Indiraji was assasinated not because of mob anger but because of inciting by congress leaders,I am not concerned when on communal demands rail roko andolan ( recently by a group of Rajasthan communal forces) made whole rail traffic go hay where  for days, buses burnt,and so also I am proud of  Kashmiri, Khalistani, Nagalandy, maoists, naxal and other voilent moments ( who killed thousands innocenets even Vaishno devi pilgrims) but I am against Baba Ramdev and his folks for not adopting such menas adopted by others,
  20.  I am proud of Indian Judiciary which only takes 30 yrs to deliver, and that there r only few ( 3 cr+) cases lying in court which will be  take just 300 yrs to get cleared.

Hi all,
All i would like to say is
that our international image is spoilt because of people like Baba
   Ramdev. It
is was just when our country was gaining a strong foothold in all fields...
that
people like the Baba have to spoilt it.
People like the Baba who
have perfected yoga to such an extent would never die from
   their fasting.
What was the need for an a/c tent etc...
It should have been the
industrialists of India to take up issues with our Government
that matter
most to our country... or our own people having a peaceful demonstrations
   all
over the country to highlight such issues.

The question of black
money being stacked in Swiss Bank has been going on for ages...
certainly our
country will benefit a lot if this money was to come back. Our cities
   and
villages could be developed on a better scale.. hence migration to our
main cities for
a livelihood would stop.
Right now, all the Indian
expats out here feel that their taxes in India go into the pot holes
   of
Mumbai streets, Kasab briyani, free slum housing for people who do not deserve
it,
the shit on the streets of mumbai,
etc.

How A Private Trust Can Help Your Daughter,Handicapped Dependent or Wife ?

India live in families. We remain concerned about the family members . The question remain foremost important in ones mind what happens after one's demise.In many unfortunate circumstances like below , one's concern is very real……

A daughter or son in the family paralysed and completely handicapped.

Son is busy with his own family and has no time for parents, who will take care of your wife who is suffering from many problems.

A daughter who is married , but son -in-law is not reliable. You fear after you he may sell the property .

You have sister who is very poor and you always helped her. You are concerned about  her. You want  to help even after your demise.

Creating a private trust can solve the aforesaid concerns of yours. Why ? Because

  1. The property or assets which you will  allocate to a trust , shall remain forever with the trust.
  2. During your life time , you yourself can be trustee.
  3. After your demise, the person you have declared in trust deed will become trustee. If you want , there can be more than one trustee.

The trustee can only do what is written in the trust deed. This means that you can actually decide before hand how the income of the trust should be spent on beneficiaries.

For example , suppose Mr X  has a house property which is given on rent . Apart from this , Mr X has 10 Lakhs cash. He has two sons , three grandson, one handicapped son, one married daughter. He wants that he should help for studies of his grandsons,handicapped son and married daughter . For this he can create trust in which he will transfer his property and Rs 10 Lakhs of cash. This will become the capital of the trust. In the trust deed , he can set forth that income earned from rent and the interest on Rs 10 Lakhs should be distributed every year in the beginning of the Financial year among his grandson , handicapped son and married daughter in following ratio

                                  Grand sons @ 10 % each.

                                  Handicapped son @ 25 %

                                  Married daughter  @ 20 %

                                 Balance with the trust.

During his life time , he himself can be come trustee, but he can prescribe person or a board of person who will become trustee after his death. The trustee will have to function according to the conditions set forth in the trust deed.In this way, at least ,financial  help will come to the persons Mr X wants .

Yes I am growing old fast. Are you aging too?????  ……do we have these things in mind before we really become dependent on family?

My one lady relative in Amer was on bed for years.  Another relative was bedridden for more than 7 years. You must have seen paralyzed, affected with parkinsonism, paraplegic, affected with dementia, sight lost, legs cut due to gangrene, diabetes, brain dead, stroke, Cancer, HIV  etc etc… but no one thinks this can happen to ….

My own mother was ailing for 3 yrs. My Daddy is also not well for last 3 months. In old age/ when u are ailing / bed ridden:

 

1.      U* need someone who can give valuable time to ailing old U.  Do you have that someone??

 

2.      U need to talk/ chit chat  ( while your hearing will be  poor, you may develop  cognitive difficulties, u can't understand what they r saying, they get irritated, angry ( and most likely u r irritated, angry, blaming, dissatisfied) , but still u need someone to give time, chit chat, listen. Do you have that someone??

 

3.      Ailing oldies forget sense of hygiene and they may do bed wetting, they need to use bed pot/ pan, their eyes, mouth, hands have to be washed by someone??? Do you have that someone??

 

 

4.      In old age U may need to be on diapers which will cost about Rs. 6000/- p.m. and another Rs.  6000 to 18000 pm u may be required to spend on bai /maid / helper if u don't have someone from family to do this necessary work or you may be lying in shit and su su for hours. Are you prepared??

 

5.      You have to be given medicines time to time. My daddy is on about 15 tablets to be given at different times. How does one remember?? Before meals, after meals, after tea time, before sleeping, if u have acidity then this additional if you have weakness then this too, if there is a fever then that too etc etc.  Luckily now medicine scheduler plastic boxes are available in market. But to use that too u need help of someone who has time and inclination. Are you ready for all this with that someone? That someone cud be ur son, daughter,  daughter in law, grand children, neighbour , old trusted friend, old reliable staff or u should be willing to pay for hired maid which costs Rs 15000/- for a month ( Rs 250/- per shift per day x 2 shift x 30days ) .Are u prepared.

 

 

6.      Your vision may go weak. Your body may  shiver, legs may tremble , you may easily get off balance and fall so :

a)      You have to keep walking area, passages, toilets etc obstruction free for walk and have to keep them well lit.

b)     You have to keep rods / support bar etc fitted in toilets.

c)      Toilets/ passages should be motorable (popularly known as handicap access) ?? Meaning if need be then your wheel chair must be able to move easily.

d)     You must have sufficient place to store sticks/ tripods/wheel chair/ pots/ pans etc .

e)      You must have (too ambitious idea??) a nice sit out/ chowk/ common area with sun rise and sun set and other activities (home or on road) visible or u will die in suffocation in kal Kothari??  My grandfather used to sit in sit out which is about 150 sq feet on first floor facing highway. Morning sun and evening set was easily visible. The staircase approach was from that sit out. Anyone coming or going from our floor would see him and talk to him. He would have tea with other neighbors' there. He would keep Mishri in a bottle (say sugar candy) and distribute to small children in building who would visit him when he was sitting alone in sit out. Then children's will play around him and thus he cud pass time easily. He was a serious reader of newspaper and kept himself updated. Once my friend Manoj visited me and as I was away he had to wait for me for a long time. Dadaji (Grandfather) started chatting with him. When I came Manoj told me that at this age of 95 yrs Dadaji has all latest info and was even discussing about my career in pharma besides on other latest topics. He would sit for 2 to 3 hours in meditation and mala japana.   

Have u taken care of all this?????????? Can u meditate and spend ur few hours daily, can u befriend young, children in some attractive / impressive way? Do your well-wishers have access to you?? I find most flats are so made that even interested well wisher too cant visit u without disturbing all in family which neither visitor nor family members (I won't dare / inappropriately blame bahu / daughter in law).So a sr. citizen is dumped ( ???) . That would be  wrong to say as when he was about to be a senior citizen at that time he  did not select right house / room, he failed to plan his old / ailing phase and thus  he can't see many faces, does not  get opportunity to talk to various people / talk on various topics , can't see activity of family/ neighbors'/ road.  

 

7.      Even if you don't have sufficient balance/ assets but need not disclose and if u have then too sleep over it. Keep sufficient bank balances, assets etc in your name and make a will which is not disclosed. Even Osho said money is not everything but it does have its own power, strength and warmness. Without it u may be left to chill high and dry.

 

8.      Keep very good relations with those friends, relatives, neighbors ,staff  who have time for you , who will visit you often or wish for your well being and or do something ( by word, deed or other means) things which will improve your comfort*** , check if things (without hurting your own family members) are all right .

But normally I have seen one likes to mix with high funda , HS ( high society) , high post  persons, persons who charm you with their post ,personality and wealth  but they are too busy to spare time  once you are permanently bedridden ( lost value). So also (be it HS or LS) keep in touch with those simple but kind hearted, compassionate, human who are nice to all .why I say so?? One who is nice to all will also always be nice to you but those who are shrewd,   different with different people, different in different circumstances are opportunists/ dual personality and may change colour when u need them and they don't need u) .

 

9.      In old age many have to be hospitalized frequently. My mother was hospitalized 5 times in 2 yrs.

Have u / your family/ friend/ neighbor/ staff have kept tel. nos. of ambulance etc ready?

 My father is surviving today because:

                                                        I.            My neighbor saw him in desperately gasping/ breathless position and woke us up at 2 am. (Ours is olden type of house where each room opens in common passage and there r neighbors too living in adjacent rooms).

                                                      II.            I had in my mobile all tel. nos. of ambulances. But incidentally only Tops responded and came in no time. (I don't think even today anyone in my family has ambulance nos.  ready with them , check if u and ur family members have???)

                                                    III.            We swiftly shifted him to casualty in a good hospital whom I knew will give very good emergency care and stabilize him without first asking for money and wasting time. I salute Hindujas for this gift (facility) to my city and several times they have proved to be more than expectations.

                                                   IV.            Credit card for immediate purpose for admission and other payments and health insurance of good value are next rescuers.

Do u have such neighbors', alarm, tel. no's of ambulance, knowledge of good hospital (and their ethical way of charging), credit card, health insurance??????  (If this mail is waking u up abt health insurance then be loyal and thankful by buying health insurance from me if u are in India and specially in Mumbai).

10.  If u have not done / seen a particular type of work and specially something like changing clothes soaked in potty of adult person then how will u be able to do it when required??

Therefore if you keep your elders like grandparents, parents with you and attend to them nicely then chances are your children will become familiar / aware/ responsible and all hesitation will vanish when u become old and dependant. If your children have not seen you sparing time for sr. citizens, bearing their tantrums, helping in their difficulties, running for their well being then chances are they will not be able to cop up with all that when u become bedridden. In that case book a place in old aged home which guarantees good comfortable stay for life time.

 

11.   Teeth: Most people neglect their teeth rather spoil them purposely by chewing all that junk, paan, paan masala, tobacco, etc..Jainism strictly wants you to not to keep your mouth jhuta ( chewing / food ). As Jainism is more of science and way of living and not a religion it tells you many do and don'ts for day to day healthy life style. So if you keep your mouth full of all junk like tobacco, frequent tea etc then they are likely to be spoilt faster than your age. Finally eating normal food becomes difficult. And then you have to depend only on soft or liquid food. Person with healthy teeth can eat well and get full nourishment. I have seen many sr. citizens unable to eat many things and often normal food also has to be grounded well in mixer grinder as they can't chew food properly. Keep your teeth healthy for your old age. And if spoilt then do not hesitate to go for dentures / implants at right time as delaying too much will make difficult to go for them. Consult Dr. Aksha Jain (dentist) the best implantologist I know. Write to me for her email id. 

12.   If you have sufficient money for secured old age then start giving attractive things in your life time to your daughter in law etc as after you it will be theirs but you are not there to get positive reaction of same. Many parents leave Jagir / saltanat/ huge wealth for heirs but do not give small bit of it in gift on occasion / exam results  to children / relatives/ staff with their own hand. Do it and see joy and change in attitude and improved relationship.

Do not want to go on and on. The mail is already very long. But pl. write back to me in few words your point of view on this mail. This has taken my many hours. Pl. spend two minutes to evaluate if u have read.
